PART I - TYPE OF CLEARING AUTHORISED
5. Requirements prior to undertaking clearing
(a) Prior to clearing any native vegetation under this Permit, the permit holder must:
(ii) if an offset is required to be implemented pursuant to condition 9(c), provide the CEO with an offset proposal for the CEO’s approval.

PART III - ASSESSMENT PRINCIPLES
9. Assessment against the Clearing Principles
(c) If part or all of the clearing to be done is or is likely to be at variance with one or more of the clearing principles, then the permit holder must implement an offset in accordance with Part V of this Permit with respect to that native vegetation.

PART V – OFFSETS
15. Determination of offsets
(a) In determining the offset to be implemented with respect to a particular area of native vegetation proposed to be cleared under this Permit, the permit holder must have regard to the offset principles contained in condition 16 of this Permit.
(b) Once the permit holder has developed an offset proposal, the permit holder must provide that offset proposal to the CEO for the CEO’s approval in accordance with condition 5(a)(ii), prior to undertaking any clearing to which the offset related, and prior to implementing the offset.

16. Offset principles
For the purpose of this Part, the offset principles are as follows:
(a) direct offsets should directly counterbalance the loss of the native vegetation;
(b) contributing offsets should complement and enhance the direct offset;
(c) offsets are implemented only once all avenues to avoid, minimise, rectify or reduce environmental impacts have been exhausted;
(d) the environmental values, habitat, species, ecological community, physical area, ecosystem, landscape, and hydrology of the offset should be the same as, or better than, that of the area of native vegetation being offset;
(e) a ratio greater than 1:1 should be applied to the size of the area of native vegetation that is offset to compensate for the risk that the offset may fail;
(f) offsets must entail a robust and consistent assessment process;
(g) in determining an appropriate offset, consideration should be given to ecosystem function, rarity and type of ecological community, vegetation condition, habitat quality and area of native vegetation cleared;
(h) the offset should either result in no net loss of native vegetation, or lead to a net gain in native vegetation and improve the condition of the natural environment;
(i) offsets must satisfy all statutory requirements;
(j) offsets must be clearly defined, documented and audited;
(k) offsets must ensure a long-term (10-30 year) benefit; and
(l) an environmental specialist must be involved in the design, assessment and monitoring of offsets.

17. Duration of offsets
(a) The permit holder must ensure that an offset implemented under this Permit continues to be implemented for the term of this Permit.

(b) If for any reason an offset is not continually implemented for the term of this Permit, the permit holder must:
(i) implement the offset again within 12 months of becoming aware that the offset is not being maintained; and
(ii) if necessary, modify the offset in a manner that increases the likelihood that the offset will be implemented for the term of this Permit.

PROJECT 1 - Bunbury Port Access Road Stage 2 and Bunbury Outer Ring Road Stage 1 (decision date of 14 November 2011).
 
Note: Clearing for this project was approved 14 November 2011, prior to the approval of an offset proposal. The offset was subsequently approved 20 December 2017 under Clearing Permit CPS 818/12. The details of this offset are published below in line with Clearing Permit CPS 818/12 permit conditions.
 
The approved offset involves the acquisition of 47.4 hectares of remnant native vegetation for conservation. The vegetation is located immediately adjacent to the proposed clearing area, is predominantly in good to very good (Keighery, 1994) condition, and contains the following environmental values:
- habitat for Carnaby's cockatoo, Baudin's cockatoo and forest red-tailed black cockatoo;
- habitat for western ringtail possum;
- significant remnant vegetation in an extensively cleared area (vegetation mapped as Heddle vegetation complexes Guildford and Southern River);
- a conservation category wetland; and
- an Environmental Protection (Swan Coastal Plain Lakes) Policy 1992 wetland.
 
The size of the offset required was determined using the Commonwealth Offsets Assessment Guide.
 
Given the above, the offset is considered relevant to the environmental values being impacted, and proportionate to the significance of the environmental values being impacted. The offset is considered consistent with the principles for the use of environmental offsets outlined in the WA Environmental Offsets Policy September 2011.

Security arrangements:

Main Roads Western Australia has purchased the offset properties. Conservation will be achieved through converting the properties into Crown Reserves vested with an appropriate government body for conservation (expected to be the Department of Biodiversity, Conservation and Attractions or the Local Government Authority).

This offset will result in the rehabilitation of 9 hectares of historical material extraction areas. The offset site is located adjacent to the clearing area and the species to be utilised in the rehabilitation were recorded in a biological survey undertaken for the clearing area. Given the size of the offset compared to the size of clearing, a net gain in the amount of native vegetation in the area will be achieved.
 
Given the above, the offset is considered relevant and proportionate to the significance of the environmental values being impacted, counterbalancing the residual impacts of the project.
 
Note: The offset area displayed in the map measures approximately 21 hectares. The offset involves rehabilitation of at least 9 hectares of the area displayed.

Security arrangements:

The proprietor of the offset location is Bush Heritage Australia. Bush Heritage Australia has agreed to MRWA's long term management for the offset site.

Rationale:

PROJECT 4 - Bussell Highway - SLK 70.76 to 72.73 - realignment south of Carbunup - Chambers Road to Island Brook (decision date of 25 January 2012)
 
This offset will result in the rehabilitation of 3.5 hectares of native vegetation predominantly in degraded to completely degraded (Keighery 1994) condition. The rehabilitation will occur within Crown Reserve 28696, a site located directly adjacent to the area of the priority ecological community (PEC) being cleared. This offset aims to improve the condition of Crown Reserve 28696 and ensure the long term protection of the remaining extent of the "Whicher Scarp floristic community B2" PEC.
 
The offset is considered to be relevant and proportionate to the significance of the environmental values being impacted, counterbalancing the residual impacts of the project.

Security arrangements:

Crown Reserve 28696 is vested with the City of Busselton for the land use purpose of 'sand extraction'. Sand extraction activity has now ceased and Main Roads will instigate a change to the purpose and Management Order of Crown Reserve 28696 to ensure the long term management and protection of the offset site.
 
Note: Following consultation with the City of Busselton undertaken by Main Roads, on 21 August 2014 the Department of Environment Regulation provided approval for Main Roads to proceed with amending the land use purpose of Crown Reserve 28696 to 'landscape protection and recreation'. The reserve will be managed into the future by the City of Busselton for this purpose.

In deciding to approve the reduced size of rehabilitation, the Department acknowledged the requirement for Main Roads Western Australia to rehabilitate 7.7 hectares of the 13 hectare clearing area being the road batters which are not required to be kept free from vegetation. In accordance with the approved offset proposal, the following is a summary of the measurable components of the offset:
 
Overall objective - revegetate the offset site with local plant species that will provide connectivity between bushland remnants, provide feeding habitat for black cockatoo species and reinstate vegetation communities that have been highly cleared.
 
Criteria for success - vegetation target density of 70% survival rate based on 1750 stems/ha which is made up of 10% upper storey, 70% middle storey and 20% understorey species and a target species diversity of 12 species per 100m2.
 
Monitoring - the density and prevalence of weeds, and the density and diversity of native species will be assessed against the criteria for success to determine the need for management and remedial action.
 
Management/remedial action (to achieve the criteria for success) - infill planting and weed control as determined through monitoring.

Rationale:

PROJECT 12 - South Coast Highway - SLK 33.5 to 35 - Manypeaks upgrade (decision date of 1 November 2012).
 
The offset involves the provision of a monetary contribution of $217,785 for the acquisition of 11.4 hectares of remnant native vegetation for conservation that contains similar environmental values to that permitted to be cleared. The area to be acquired was calculated using the Commonwealth Offsets Assessment Guide.
 
Given the above, the offset is considered relevant and proportionate to the significance of the environmental values being impacted, counterbalancing the significant residual impacts of the clearing.
 
Note: Clearing for this project was approved 1 November 2012, prior to the approval of an offset proposal. The offset was subsequently approved 18 July 2014 under Clearing Permit CPS 818/11. The details of this offset are published below in line with Clearing Permit CPS 818/11 permit conditions.
