Project bioregion(s) Swan Coastal Plain
Assessment criteria (a) it comprises a high level of biological diversity., (b) it comprises the whole or a part of, or is necessary for the maintenance of, a significant habitat for fauna indigenous to Western Australia.
Residual impact

Loss of up to 7.5 hectares of native vegetation in excellent (Keighery 1994) condition that contains high species richness and significant habitat for a range of indigenous fauna including nesting hollows in mature Tuart trees.

Offset conditions

Condition 2:
(a) Determination of offsets
(i) If part or all of the clearing to be done is or may be at variance with one or more of the clearing principles, then the Permit Holder must implement an offset in accordance with Conditions 2 (a) and 2 (b) of this Permit with respect to that native vegetation.
(ii) In determining the offset to be implemented with respect to a particular area of native vegetation proposed to be cleared under this Permit, the Permit Holder must have regard to the offset principles contained in condition 2 (b) of this Permit.
(iii) Once the Permit Holder has developed an offset proposal, the Permit Holder must provide that offset proposal to the CEO for the CEO’s approval prior to undertaking any clearing to which the offset relates, and prior to implementing the offset.
(iv) Clearing may not commence until and unless the CEO has approved the offset proposal.
(v) The Permit Holder shall implement the offset proposal approved under condition 2 (a)(iii).
(vi) Each offset proposal shall include a direct offset, timing for implementation of the offset proposal and may additionally include contributing offsets.

(b) Offset principles
For the purpose of this Part, the offset principles are as follows:
(i) direct offsets should directly counterbalance the loss of the native vegetation;
(ii) contributing offsets should complement and enhance the direct offset;
(iii) offsets are implemented only once all avenues to avoid, minimise, rectify or reduce environmental impacts have been exhausted;
(iv) the environmental values, habitat, species, ecological community, physical area, ecosystem, landscape, and hydrology of the offset should be the same as, or better than, that of the area of native vegetation being offset;
(v) a ratio greater than 1:1 should be applied to the size of the area of native vegetation that is offset to compensate for the risk that the offset may fail;
(vi) offsets must entail a robust and consistent assessment process;
(vii) in determining an appropriate offset, consideration should be given to ecosystem function, rarity and type of ecological community, vegetation condition, habitat quality and area of native vegetation cleared;
(viii) the offset should either result in no net loss of native vegetation, or lead to a net gain in native vegetation and improve the condition of the natural environment;
(ix) offsets must satisfy all statutory requirements;
(x) offsets must be clearly defined, documented and audited;
(xi) offsets must ensure a long-term (10-30 year) benefit; and
(xii) an environmental specialist must be involved in the design, assessment and monitoring of offsets.

Decision(s):

DECISION 1
Date: 2015-04-23 Ministerial statement: None
OFFSET 1
Condition status: Current
Type(s): Onground management
Rationale:

This offset involves the rehabilitation of approximately 1 hectare of Harry Perry Reserve and the management of remaining areas of the reserve totalling 3.73 hectares. Harry Perry Reserve is located approximately 2 kilometres north of the project area.
When combined with offset 2, a total of 3.5 hectares will be rehabilitated and a total of 49.3 hectares will be managed for conservation.
The offsets combined are considered relevant and proportionate to the significance of the environmental values being impacted, mitigating the residual impacts of the project.

Security arrangements:

Crown Reserve 47852 is vested in the City of Mandurah for public recreation and Crown Reserve 48319 is vested in the City of Mandurah for landscape buffer.

Governance arrangements:

Offset location:

The three lots which form Harry Perry Reserve are:
1 - Lot 377 on Plan 29370 (19 Karinga Rd, Madora Bay), Crown Reserve 47852 - 2.30 hectares.
2 - Lot 378 on Plan 29370 (3 Karinga Rd, Madora Bay), Crown Reserve 47852 - 1.92 hectares.
3 - Lot 999 on Plan 38712 (1 Karinga Rd, Madora Bay), Crown Reserve 48319 - 0.51 hectares.

OFFSET 2
Condition status: Current
Type(s): Onground management
Rationale:

This offset involves the rehabilitation of approximately 2.5 hectares of Marlee Reserve and the management of remaining areas of the reserve totalling 45.57 hectares. Marlee Reserve is located approximately 2 kilometers north of the project area and contains vegetation types similar to that being cleared. The rehabilitation will also involve the establishment of Tuart trees to improve fauna habitat values of the reserve.
When combined with offset 1, a total of 3.5 hectares will be rehabilitated and a total of 49.3 hectares will be managed for conservation.
The offsets combined are considered relevant and proportionate to the significance of the environmental values being impacted, mitigating the residual impacts of the project.

Security arrangements:

Lot 806 on Plan 31127 and Lot 3048 on Plan 17117 form Crown Reserve 41392 which is vested in the City of Mandurah for public recreation.
Lot 9015 on Plan 48694 is freehold land owned by the City of Mandurah.

Governance arrangements:

Offset location:

The three lots which form Marlee Reserve are:
