3. Native vegetation conservation

(a) In respect to the area shaded red on attached Plan 3967/2, the Permit Holder shall enter into a conservation covenant, agreement to reserve, or some other form of binding undertaking to maintain native vegetation.
(b) The conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation, shall include, but not be limited to, the following conditions:
(i) native vegetation in the area subject to the conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation, must not be cleared, other than for clearing required under the Bush Fires Act 1954;
(ii) the land subject to the conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation, shall not be used for the purpose of cultivation of crops or pasture;
(iii) the land subject to the conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation, shall have all stock excluded; and
(iv) the conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation, is to apply in perpetuity and be registered on the Certificate of Title of the property.
(c) The Permit Holder is to execute and return the conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation, outlined in condition 3(a) of this Permit, no later than 30 April 2014.

Rationale:

The offset will result in 44 hectares of Carnaby's cockatoo foraging habitat, adjacent to the Bashford Nature Reserve, being secured for conservation.

The offset is considered to be relevant and proportionate to the significance of the environmental value being impacted, counterbalancing the residual impacts of the project.

Security arrangements:

Lot 3909 on Plan 210000 is freehold land held by the Permit Holder. The offset area will be subject to a conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation.

In respect to the area shaded red on attached Plan 3967/2 (portion of Lot 3909 on Plan 210000), the Permit Holder shall enter into a conservation covenant, agreement to reserve, or some other form of binding undertaking to maintain native vegetation.

Timeframe:

The Permit Holder is to execute and return the conservation covenant, agreement to reserve, or other form of binding undertaking to maintain native vegetation no later than 30 April 2014.

Note: The Permit Holder ultimately ceded the offset area to the Department of Parks and Wildlife for conservation without compensation. This approach was supported by the Department of Environment Regulation. The land transfer occurred 27 February 2017. The offset site now forms part of Lot 901 on Deposited Plan 409611, Mimegarra. The entire of Lot 901 is proposed to be amalgamated into the Bashford Nature Reserve along with offsets imposed under clearing permits CPS 2926/4 and CPS 205/2.
