Offset conditions

Condition 8:
Assessment against the Clearing Principles

In complying with condition  of this Permit, the Permit Holder must have regard to the Department's "A Guide to the assessment of applications to clear native vegetation under the Environmental Protection Act 1986" contained in Annexure 1 to this Permit, when conducting an assessment of the proposed clearing against the clearing principles.

If part or all of the clearing to be done is likely to be seriously at variance with one or more of the clearing principles then condition (t) of this Permit applies.

If part or all of the clearing to be done is likely to be at variance with one or more of the clearing principles, then the Permit Holder must implement an offset in accordance with Part V of this Permit with respect to that native vegetation, unless written advice to the contrary is provided by the CEO.

If part or all of the clearing to be done is likely to be at variance or may be at variance with one or more of the clearing principles, the Permit Holder must implement a VMP in accordance with condition  of this Permit, with respect to that clearing, unless written advice to the contrary is provided by the CEO.

Condition 13:
Determination of offsets

The Permit Holder must prepare an offset proposal, designed by an environmental specialist, if an offset is required by condition 8(c) of this Permit.

In determining the offset to be implemented with respect to a particular area of native vegetation proposed to be cleared under this Permit, the Permit Holder must comply with the principles in the Government of Western Australia, WA Environmental Offsets Policy, September 2011 and have regard to the WA Environmental Offsets Guidelines, August 2014.

An offset proposal is not required if the CEO advises so in writing.

Once the Permit Holder has developed an offset proposal, the Permit Holder must provide that offset proposal to the CEO for the CEO's approval, prior to undertaking any clearing to which the offset is related, and prior to implementing the offset.

If it is necessary to modify the offset proposal approved by the CEO, then the Permit Holder must provide that modified offset proposal to the CEO for the CEO's approval and prior to implementing the modified offset.

The Permit Holder must implement the latest version of the offset proposal approved by the CEO.

Condition 14:
Monitoring
The Permit Holder must monitor:

areas revegetated and rehabilitated under this Permit to determine compliance with the relevant Revegetation Plan and the conditions of this Permit; and

areas that are the subject of an offset implemented under this Permit to determine compliance with the relevant approved offset and the conditions of this Permit.

Condition 3:
(a) OffsetsIf part or all of the clearing to be done is or may be at variance with one or more of the clearing principles, then the Permit Holder must implement an offset in accordance with this condition and condition of this Permit with respect to that clearing. Where clearing authorised under this Permit impacts , the Permit Holder must implement an offset in accordance with conditions (a) and (b) of this Permit with respect to that clearing.(b) Determination of offsets     (i) If required by condition of this Permit, the Permit Holder must develop an offset proposal and implement an offset in accordance with conditions of this Permit with respect to that clearing.     (ii) In determining the offset to be implemented with respect to a particular area of native vegetation proposed to be cleared under this Permit, the Permit Holder must comply with the offset principles contained in condition of this Permit.     (iii) Each offset proposal shall include a direct offset, timing for implementation of the offset, criteria for determining success of the offset, remedial actions to ensure success of the offset, and may additionally include contributing offsets.     (iv) Once the Permit Holder has developed an offset proposal, the Permit Holder must provide that offset proposal to the CEO for the CEO’s approval in accordance with condition of this Permit.  The clearing to which the offset relates and the implementation of the offset shall not take place until the Permit Holder receives approval first from the CEO.     (v) The Permit Holder shall implement an offset in accordance with an offset proposal approved under condition and of this Permit.(c) Offset principles For the purpose of this Part, the offset principles are as follows:     (i) direct offsets should directly counterbalance the loss of the native vegetation;     (ii) contributing offsets should complement and enhance the direct offset;     (iii) offsets are implemented only once all avenues to avoid, minimise, rectify or reduce environmental impacts have been exhausted;     (iv) the environmental values, habitat, species, ecological community, physical area, ecosystem, landscape, and hydrology of the offset should be the same as, or better than, that of the area of native vegetation being offset;     (v) a ratio greater than 1:1 should be applied to the size of the area of native vegetation that is offset to compensate for the risk that the offset may fail;     (vi) offsets must entail a robust and consistent assessment process;     (vii) in determining an appropriate offset, consideration should be given to ecosystem function, rarity and type of ecological community, vegetation condition, habitat quality and area of native vegetation cleared;     (viii) the offset should either result in no net loss of native vegetation, or lead to a net gain in native vegetation and improve the condition of the natural environment;     (ix) offsets must satisfy all statutory requirements;     (x) offsets must be clearly defined, documented and audited;     (xi) offsets must ensure a long-term (10-30 year) benefit; and     (xii) an environmental specialist must be involved in the design, assessment and monitoring of offsets.(d) Duration of offsets     (i) The Permit Holder must ensure that an offset implemented under this Permit continues to be implemented for the term of this Permit.     (ii) If for any reason an offset is not continually implemented for the term of this Permit, the Permit Holder must:          A. Implement the offset again within 12 months of becoming aware that the offset is not being maintained; and          B. If necessary, modify the offset in a manner that increases the likelihood that the offset will be implemented for the term of this Permit.

 This offset involves the provision of a monetary contribution of $134,235 for the acquisition of 15 hectares of remnant native vegetation for conservation that contains similar environmental values to that permitted to be cleared. When combined with Offset 7, a total of 17.94 hectares of native vegetation with similar environmental values to that permitted to be cleared is required to be established/conserved. The required size of the combined offset was determined using the Commonwealth Offsets Assessment Guide.
 
With the funds provided a portion of Lot 4470 on Deposited Plan 29854, Karridale was purchased for conservation. Lot 4470 is approximately 197.4 hectares in size and contains approximately 114.5 hectares of remnant vegetation. The vegetation present comprises of 58.1 hectares of wetland vegetation and 56.4 hectares of upland remnant vegetation consisting of jarrah and marri.
 
 The vegetation on Lot 4470 includes foraging and possibly nesting habitat for Carnaby's cockatoo, Baudin's cockatoo and forest red-tailed black cockatoo. The vegetation on the property also includes suitable habitat for the western ringtail possum, and core habitat for another critically endangered fauna species. All three black cockatoo species and the western ringtail possum have been recorded on neighbouring properties within similar habitat.
 
 The vegetation is considered to represent significant remnant vegetation in an area that has been extensively cleared with the wetland vegetation representing 6% of the remaining extent (less than 1000 ha) of the Glenarty Hills wet (Hw) vegetation complex. The vegetation is also considered to form ecological linkages with surrounding remnant vegetation including areas already reserved for conservation. It follows that the vegetation is considered to contain a high level of biodiversity.
 
 The funds provided enabled 13.95 hectares of the 114.5 hectares of remnant vegetation on Lot 4470 to be purchased. Offset Fund contributions received as a condition of the following clearing permits were also used to acquire Lot 4470:

PROJECT 6 - Albany Highway - SLK 285.5 to 291 - Tunney passing lanes (decision date of 30 June 2015)
 
The approved offset involves the conservation and rehabilitation of a 22.35 hectares of the old Tunney townsite to achieve similar environmental values to that permitted to be cleared. The area was calculated using the Commonwealth Offsets Assessment Guide. The remaining 75.95 hectares meets the requirements to be considered a strategic or banked asset for MRWA. 
 
Given the above, the offset is considered relevant and proportionate to the significance of the environmental values being impacted, counterbalancing the significant residual impacts of the clearing.

Security arrangements:

Note: On 30 June 2015, the former Department of Environment Regulation (DER) approved the clearing of 5.31 hectares of native vegetation for the Albany Highway Tunney passing lanes project. The approval was subject to an offset condition requiring the provision of $70,000 to DER for the acquisition of 35 hectares of native vegetation for the purpose of conservation. The payment was made in full on 15 September 2015.
 
Following receipt of the funds, DER made a number of enquiries with the former Department of Parks and Wildlife (DPaW) in an attempt to identify a suitable property for acquisition. No suitable properties were identified through those enquiries. Given this, MRWA committed to identifying a suitable property.
 
In a letter of 27 April 2020, Main Roads Western Australia (MRWA) advised that three sites on the old Tunney townsite (Reserve numbers R29057 (areas 1 and 2), R18335 (area 3) and R29056 (area 4)) were identified as potential offset options. 
 
Native Vegetation Regulation Branch (NVR) has assessed the proposed alternative offset, including a review of the rehabilitation plan, and considers that it more than counterbalances the impacts of the approved clearing.

 The approved offset involves the provision of a monetary contribution of $427,273 for the acquisition of 31 hectares of remnant native vegetation for conservation that contains similar environmental values to that permitted to be cleared. The area to be acquired was calculated using the Commonwealth Offsets Assessment Guide.
 
With the funds provided a portion of Lot 4470 on Deposited Plan 29854, Karridale was purchased for conservation. Lot 4470 is approximately 197.4 hectares in size and contains approximately 114.5 hectares of remnant vegetation. The vegetation present comprises of 58.1 hectares of wetland vegetation and 56.4 hectares of upland remnant vegetation consisting of jarrah and marri.
  
The vegetation on Lot 4470 includes foraging and possibly nesting habitat for Carnaby's cockatoo, Baudin's cockatoo and forest red-tailed black cockatoo. The vegetation on the property also includes suitable habitat for the western ringtail possum, and core habitat for another critically endangered fauna species. All three black cockatoo species and the western ringtail possum have been recorded on neighbouring properties within similar habitat.
 
 The vegetation is considered to represent significant remnant vegetation in an area that has been extensively cleared with the wetland vegetation representing 6% of the remaining extent (less than 1000 ha) of the Glenarty Hills wet (Hw) vegetation complex. The vegetation is also considered to form ecological linkages with surrounding remnant vegetation including areas already reserved for conservation. It follows that the vegetation is considered to contain a high level of biodiversity.
 
 The funds provided enabled 31.00 hectares of the 114.5 hectares of remnant vegetation on Lot 4470 to be purchased. Offset Fund contributions received as a condition of the following clearing permits were also used to acquire Lot 4470:
- CPS 818/11 Margaret River Perimeter Road Stage 2 (2.61 hectares)
- CPS 6895/1 Wests Gravel Pit (35.85 hectares)
- CPS 818/12 Donnybrook – Kojonup Road Widening SLK 6 to 27.6 (10.50 hectares)

PROJECT 8 - Caves Road - SLK 20.3 to 24.6 - shoulder widening (decision date of 14 September 2015)
 
The offset involves the rehabilitation of 0.08 hectares of an informal track within Lot 301 on Plan 49920 that links Caves Rd and Marrinup Rd (approximately 1.4 kilometres south of the project clearing). This portion of Crown Reserve 8428 supports an existing population of Caladenia excelsa and also contains suitable habitat for black cockatoos and western ringtail possum. Closure and rehabilitation of the track will help improve the long term viability of this portion of the reserve, including the Caladenia excelsa population, with ongoing use of the track posing degradation risks through weed and dieback spread and trampling of vegetation.
 
Given Crown Reserve 8428 contains vegetation with similar values to that being cleared, the offset is considered relevant to the environmental values being impacted. After investigation it was determined that few offset opportunities exist for Caladenia excelsa, and closure of the track was the most appropriate and viable option in this case, especially given its proximity to the project. Although the size of rehabilitation is small in comparison to the size of clearing, it is expected that the works will assist in enhancing and maintaining the environmental values of a much larger area of adjoining vegetation. Therefore the offset is also considered proportionate to the significance of the environmental values being impacted.

The difference of 402.6 hectares was funded through offset fund contributions received as a result of clearing permit conditions imposed on three other Main Roads Western Australia projects:
1. CPS 818/11 - Narrogin Link Road Stage 2 South - 5.8 hectares
2. CPS 818/11 - York Merredin Road - SLK 51 to 66 - widening and Dangin Mears Road intersection upgrade - 30.86 hectares
3. CPS 6800/1 - York Merredin Road - SLK 1.95 to 51 - widening - 365.94 hectares
Note: The offset area displayed in the map is that of the entire 407.4 hectares (i.e. all five lots).
 
Based on information obtained from a site inspection undertaken by Department of Environment Regulation officers, it is considered that the five lots contain the following environmental values:
- suitable foraging, nesting and roosting habitat for black cockatoos;
- suitable foraging and breeding habitat for red-tailed phascogale;
- approximately 278 hectares of vegetation representative of the threatened ecological community Eucalypt Woodlands of the Western Australian Wheatbelt; and
- vegetation significant as a remnant in an area that has been extensively cleared (the vegetation is mapped as Beard vegetation association 946 which retains approximately 19 per cent of its pre-European extent in the Avon Wheatbelt bioregion).
 
The majority of the vegetation is dominated by Eucalyptus wandoo and was considered to be in very good condition or better based on the Keighery (1994) scale. Large trees with hollows were observed regularly. Potential evidence of black cockatoo foraging on Banksia prionotes was also observed and black cockatoo calls were heard from nearby vegetation.
 
Given the above, the offset is considered to be relevant and proportionate to the significance of the environmental values being impacted, counterbalancing the residual impacts of the project.
